KASTAM KESAN SYARIKAT TIPU GST



SUNGAI PETANI: Jabatan Kastam Diraja Malaysia (JKDM) mendedahkan segelintir syarikat perniagaan dikesan culas dalam soal pelaksanaan cukai barang dan perkhidmatan (GST) di negeri ini. Selain tidak menjelaskan bayaran walaupun penyata GST dihantar kepada JKDM, ada peniaga dikesan menipu pengguna dengan tidak mengeluarkan resit untuk mengaut cukai yang dikenakan kepada pengguna, sedangkan ia tidak dimasukkan dalam data GST.

Pengarah JKDM negeri, Johari Alifiah, berkata ia antara taktik digunakan premis atau syarikat perniagaan untuk mengelak GST, terutama yang berurusan secara dalam talian.

ALOR SETAR - Jabatan Kastam Diraja Malaysia (JKDM) Kedah sedang mengesan lima peratus daripada 14,000 pemilik perniagaan yang gagal mengemukakan penyata Cukai Barang dan Perkhidmatan (GST) sejak ia dilancarkan tahun lalu.

Timbalan Pengarah Kastam Negeri Kedah, Mohd Noor Yusoff berkata, jumlah itu dikesan telah melakukan kesalahan dengan tidak menghantar penyata GST dalam tempoh yang ditetapkan termasuk pemilik yang menghantar penyata namun gagal menyertakan bayaran GST.

"Sekiranya tiada alasan kukuh, mereka boleh dikenakan tindakan mengikut Seksyen 41 (6) Akta GST 2014 yang memperuntuk hukuman denda maksimum RM50,000 atau penjara maksimum tiga tahun atau kedua-duanya," katanya kepaad pemberita pada majlis penyampaian hadiah Jom Minta Resit GST di sini hari ini.

KASTAM KELANTAN BURU 3,474 PENIAGA GAGAL JELASKAN GST


KOTA BHARU - Jabatan Kastam Diraja Malaysia (JKDM)  memburu 3,474 peniaga berdaftar yang masih gagal menjelaskan kutipan Cukai Barang dan Perkhidmatan (GST) sebanyak RM6 juta di negeri ini.

Pengarahnya, Mohd Nasir Yusof berkata, peniaga berkenaan diburu menerusi Operasi Strategi Lautan Biru Kastam (CBOS) 3.0 bermula hari ini hingga 31 Disember tahun ini.

"Seramai 30 pegawai  Bahagian GST, pematuhan serta penguatkuasaan akan ditugaskan membuat audit verifikasi ke atas peniaga berdaftar dari sektor pembinaan dan hartanah, pengusaha restoran, peruncit serta kedai perkakasan," katanya kepada pemberita selepas pelancaran CBOS 3.0 di Pejabat JKDM Padang Bongor di sini, hari ini.

Mengikut Operasi CBOS 3.0 itu, JKDM akan memberi tempoh 30 hari kepada pemilik syarikat berdaftar supaya melakukan pindaan Penyata GST bermula daripada tarikh pemeriksaan sekiranya verifikasi audit mendapati bayaran yang dibuat peniaga adalah rendah berbanding jumlah pendapatan harian mereka.

"Jabatan tidak teragak-agak mengambil tindakan mahkamah dan mengenakan penalti sehingga 40 peratus daripada amaun yang kurang bayar terhadap syarikat berdaftar yang gagal mematuhi perundangan jabatan," katanya.

CUSTOMS AIMS TO COLLECT ADDITIONAL RM3B IN GST NEXT YEAR (2017)

JOHOR BARU: The Customs Department aims to collect an additional RM3 billion in Goods and Services Tax (GST) next year following the implementation of its Customs Blue Ocean Strategy (CBOS) initiative.

The amount comes from unpaid or under-declared GST by the registrants.
Customs Department deputy director general (enforcement and compliance) Datuk T. Subromaniam said under the CBOS initiative, the department would focus on informed compliance rather than enforced compliance.

"We found that there are still people who are confused or do not understand the requirements under GST. With this initiative, we would focus on educating these people so that they would have the proper understanding of GST and would make the necessary declarations to the department," said Subromaniam.

COSMETICS TYCOON DATUK VIDA PLEADS GUILTY TO 16 GST-RELATED CHARGES, FINED RM80,000

IPOH: Flamboyant cosmetic entrepreneur Datuk Seri Hasmiza Othman, better known as Datuk Vida, was fined RM80,000 over 16 charges of failing to submit Goods and Services Tax (GST) statements between April 1, 2015 and July 31, 2015. 

Hasmiza pleaded guilty – after originally pleading not guilty – at the Sessions Court here over the 16 charges of failing to submit GST statements to the Customs Department.

However, the founder of Vida Beauty Sdn Bhd pleaded not guilty to another 16 charges of failing to pay GST, and requested that the case be re-mentioned.

The decision was handed down by Judge Murtazadi Amran after the accused’s lawyer, Syed Ahmad Syed Abas, told the court that his client wanted to make an admission of guilt.

Telco company owner fined for failing to submit GST statement

IPOH: An owner of a telecommunication company was fined a total of RM40,000 by the Sessions Court here today on eight charges with failing to submit the Goods and Services Tax (GST) statement to the Royal Customs Department.

Judge Murtazadi Amran meted out the fine of RM5,000 on each charge, in default six months' jail, on Wong Kean Yik, 35, who pleaded guilty to the charges.

Before meting out the fine, Murtazadi said he had taken into account several factors, including public interest, and also the implication arising from the failure to submit the statement to the Customs Department.

IPOH: Cosmetics entrepreneur Datuk Seri Hasmiza Othman, popularly known as 'Dr Vida', was charged at the Sessions Court here today with failing to pay the Goods and Services Tax (GST) totaling more than RM4 million.

The founder of Vida Beauty Sdn Bhd was slapped with 32 counts under two offences according to the Goods and Services Tax Act 2014, namely for failing to pay the tax and for failing to produce GST statements.

SYARIKAT PERKAYUAN DIDAKWA KERANA GAGAL BAYAR GST RM68,021.40

TANAH MERAH - Mahkamah Majistret, di sini, semalam, memerintahkan sebuah syarikat perkayuan membayar tuntutan cukai GST berjumlah RM68,021.40 secara rundingan dengan Jabatan Kastam Diraja Malaysia (JKDM).

Keputusan dibuat Majistret Mohd Isa Mohamed selepas mendapati saman sivil dikemukakan JKDM Kelantan menunjukkan syarikat terbabit gagal melunaskan bayaran penuh tuntutan GST dalam tempoh bercukai ditetapkan.

Syarikat milikan tunggal, Perkayuan Era Baru yang beralamat di Kampung Banggol Kemunting, dekat sini, didakwa gagal membuat bayaran penuh tuntutan GST bagi tempoh bercukai dari 1 April 2015 hingga 30 Jun 2016.

Kegagalan syarikat terbabit membayar GST yang dituntut selepas penyata dikemukakan kepada JKDM bagi tempoh bercukai tersebut merupakan satu kesalahan di bawah Seksyen 41(4) Akta GST 2014.

IPOH: A mobile phone shop owner was slapped with eight charges over his failure to submit the Goods and Services Tax (GST) statement for the period of May until December last year.

Wong Kean Yik, 35, the owner of Sun Yi Telecommunication Trading, pleaded guilty to all charges which were read to him by a court translator in front of Sessions Court judge Murtazadi Amran.

Wong was charged with failure to submit the GST statements from May until December 2015 under Section 41(1) of the Goods and Services Tax Act 2014. All the offences fell under Section 41 (6) of the same Act.

They are punishable with a fine not exceeding RM50,000 for each charge or imprisonment of up to three years, or both, for each count.

IPOH - Pemilik sebuah syarikat telekomunikasi mengaku bersalah di Mahkamah Sesyen di sini hari ini atas lapan pertuduhan gagal mengemukakan penyata cukai Barang dan Perkhidmatan (GST) kepada Jabatan Kastam Diraja Malaysia (JKDM) untuk tempoh lapan bulan.

Wong Kean Yik, 35, yang juga pengarah Sun Yi Telecommunication Trading membuat pengakuan itu selepas pertuduhan dibacakan di hadapan Hakim Murtazadi Amran.
